funny you mention this, I used it in combination CCC section 794.2 and had my drug charges dismissed 794.2 Burden of proving exception, etc. (2) The burden of proving that an exception, exemption, proviso, excuse or qualification prescribed by law operates in favour of the defendant is on the defendant, and the prosecutor is not required, except by way of rebuttal, to prove that the exception, exemption, proviso, excuse or qualification does not operate in favour of the defendant, whether or not it is set out in the information. This and proof Canada is Registered in Washington D.C. There is lawful excuse, problem is.... they now just make it up as they go along

thats my understanding. When I asked duty council to bring this forward he said he could not use it to defend me. when i went back into court a new duty council was in his chair and they sent me to a different court room

:o WTF! :D Thanks for sharing Pete. Are all acts and statutes not in fact "de facto". All courts are "de facto" courts. And unless I'm mistaken the Governor General is the "de facto" QUEEN How does this work when the Governor General is a man? Lol! CORRECTION: Head of State NOT Queen.

Fuck that's right! And I'm almost certain that you've mentioned this before too :) So I'm wondering, why is the Governor General also referred to as the "de facto" HEAD OF STATE? Does the Governor General have a dual role?

*SIGH* THERE ARE NO HOMONYMS IN LAW THERE ARE NO SYNONYMS IN LAW What does a GOVERNOR in a MECHANISM do? The GOVERNOR GENERAL can slow down and/or stop government. THAT IS ALL! A GOVERNOR on a MOTOR SLOWS IT DOWN OR STOPS IT when certian parameters are exceeded.
