I wasn't scared really just trying to think of everything at once... I'm worried now that when he asked "So YOU are not Eamonn O Brien" I replied. I should have asked "are you addressing me?"... When he stated that he wouldn't talk to me because I wouldn't give a full name I should have said by refusing to talk to me you will be accepting surety do you wish to not talk to me? Or something like that... Easy now to think of once I'm sat in the comfort of my home...

I've been thinking about today and really, I achieved nothing... I might as well not have been there... They still fined EAMONN O BRIEN and that fine will be posted out to the house. All I can do is send another notice of mistake with an affidavit stating what happened today and give them a few days to respond to rebut the affidavit. My guess is it'll result in a warrant and eventually get picked up some day while driving... :/

It's not liened. I still use it. This particular case was a speeding fine in which the first contact was a letter in the door. Every charge is a new person so I went from there... The judge was playing dumb and went ahead and fined the person anyway...

I didn't know how tolerant he would be before ordering I be taken away... I just about got "by what authority" out... I know he should be the one worrying about my tolerance but again, fear sets in... I should have pushed more for him to read my affidavit and paperwork. Spent time putting it together. Going in one doesn't know what situation they will be presented with. Couldn't get passed the name... Does the fact that a courtroom full of people saw the judge establish that I wasn't EAMONN O BRIEN count at all Scott?

Anxiety is "normal" but in excess becomes a psychological disorder. Anxiety is not the same as fear, which is a response to a real or perceived immediate threat; whereas anxiety is the expectation of future threat. This uncomfortable state is characteristically experienced during addressing an audience but can be overcome with practice and experience. "Glossophobia" is common in people because it deals in an uncommon action. There are extremes but most people can overcome it. In this circumstance Eamonn O Brien, I can think of a few contributions to the EMOTIONS you felt. - Glossophobia, the fear of public speaking - Stress, developed by anticipation with anxiety and rumination - Fear, of the court; outcome * Fight or Flight, involuntary response system to traumatic experiences First, emotions are an aid for the body to react to various stimuli. Emotions characterized as "negative" are survival mechanisms; anxiety, fear, anger, rage, etc. Fears and stresses are "normal" but if they exceed the management of the psyche, trauma ensues. With an already heightened stress level, a trauma can easily trigger a "fight or flight" response which is basically a surge of hormones and chemicals; dopamine, adrenaline and cortisol, to name a few. Mannerisms depicting nervousness derive from this state and can be from drumming fingers to losing consciousness. Some who have been traumatised repetitiously or in extreme may develop a similar reaction in higher extreme called the "Amygdala Hijack" which is triggered even more easily. This is common in those diagnosed with Post Traumatic Stress Disorder, PTSD, though not limited to. It is important to grasp the hierarchy of thought processes... Faced with something new, the mind must process all the information to come to a solution. After the solution has been found to be correct and used several times, it becomes "second nature" or "automatic", no longer required to be calculated each and every time. Familiarizing yourself with the courtroom, practicing and with others who try to trip you up will help to overcome the situation. Check the link for more. https://www.mtholyoke.edu/acad/intrel/speech/anxiety.htm Hope that helps. :D

It's easy to type, but is not the same when one is in front of "all mighty government god." One thing it got stuck on my head was the whole "The Master asks the questions. The servant answers/responds." You see, it was clear to me that we have been trained to be in position of servants. It's bad to question things, more so if it's questioning a figure of "authority." It is weird to respond to a question, like if you were in Jeopardy. But "I've got it." J: What's your name? Me: Are YOU addressing ME? That thing. ^^^ If I make the questions, I am in control.

Also, it looks like at the first indication of bias, or incompetence from that Justice, one needs to question his/her competence, and ask for the justice to recuse him/herself. Another thing is: J: Then I'll just have to fine Eamonn O Brien 250 and give him 1 month to pay. Me: OBJECTION! You still have not address the questions of the Notice of Mistake, have you not? Until you answer each of those questions, then I cannot understand the nature and cause of these proceedings. Have I made wishes clear to YOU? As you, and I said, it's easier said than done. So there is that.

@Pete, why would you feel the need to reserve your inherent rights? You already have them. 'Cause I'm guessing you're not looking to reserve THEIR rights, are you? If your paperwork clearly identifies THEM as Trustees, you would then be reserving the rights of Trustee and thus, be reclaiming the surety. I hope that makes sense. In my opinion, that is being double minded as it could technically be an action which counteracts the notice of mistake, if one was submitted. I'd would invite you to simply stand on the fact that THEY DON'T HAVE in personam jurisdiction. One question - What evidence do you have that I volunteered to be a citizen, subject or employee under the authority of YOUR jurisdiction? @David-Paul, they can only proceed if you allow them to - "POINT OF ORDER, there is an unanswered questions before this court - What evidence do you have that I volunteered to be a citizen, subject or employee under the authority of YOUR jurisdiction? Take charge, grow some fucking balls and let them know you mean business ;)

You got it Pete - Mr Justice WHY are you NOT answering the questions? What are you hiding? Are you perpetrating a FRAUD here today? Is this an honorable court?... On the whole being surrounded by Sheriffs thing, I've been there and done that too. As long as you make it clear that YOU DO NOT CONCENT TO BEING PHYSICALLY TOUCHED IN ANY WAY, SHAPE OR FORM, they will not touch you. In fact, a friend of mine did that and had the Justice YELL at the sheriffs/bailiffs to NOT touch my friend after expressing that in court. "DO NOT TOUCH HIM!" - he actually yelled it out. To me, that's fascinating. In my experience they'll just circle you and stand there, waiting to see what comes next.

Eamonn O Brien less is best. So they dont try to trick or scare you into their jurisdiction. Just start as you did and then rebut all presumptions and read the notice of mistake. You need these questions answered before you can have an understanding, on the record and at the end close the record with You have not answered my questions and leave. Well in my last case the judge had the officer throw me out of the courtroom and locked the door behind me.

There's not much mention of freemen on the land here really. They have next to no credibility to be mentioned. Republicans is a label attached to southerners who sided for the treaty granting Ireland a legal status under the crown back in 1921... The south is known as the Republic. It's a legal title... People don't know that though. They think we fought and won our freedom from 1916-1921... (Not that there's not much credibility for "freemen" but not alot of people are out there applying it... Only a few of us in The Tender for Law here. The only solid resource for law)

Good thread. Thanks for sharing your experience Eamonn O Brien.Anyone would be nervous taking the helm of a ship in shallow harbour for the first time if all you ever did was read about it. What Steeve Contributing Beneficiary says above makes sense to me with exception to what David-Paul Sip added about AGENCY and presumption *If, you haven't formally resigned already. Still it does seem to be a presumption? No one ever told me about it other than Scott so asking for EVIDENCE of AGENCY appears fair. Clearly there has been no meeting of the minds. I didn't notice Scott Duncan correct any of that. How do we keep the Justice in the TRUSTEE role? Is asking questions of the court enough? Is there a specific way of asking for these roles to be maintained beyond what SCB stated?

I don't get why ppl bother going into court if you have not had any practise??? Like wtf ... gather with some friends and have the best one play the judge. Simple go In and do it like how you wish to. He'll even have a guy there standing close to you as the guard. I did this at seminars and even thoe I played the judge ... ppl were still nervous. Once you do it over and over u become relaxed and not as tense. I always say ... if fear kicks In. ..read from a script or at least have a few responses to use in case you freeze up. . Ffs... it's easy why yall go Inn there and make it harder for the next guy... judges use ur fuck ups as case law ... duh so stop going in so stupid ... or at least get a contract with the court before you enter. Are you John doe .. do you not know who your looking for ?? Is there a problem with me being here as a interested 3rd party who has a vested interest in the person in question.... judge: what is ur name ... you may refer to me as a friend of the court or defendant ... refer just means you will take it under consideration only ... doesn't anyone anyone how to talk to the damn judge -????? Well clearly Micheal ppl do ... they clearly Suck while in court .. freeze up and tremble under the judge ... so you have audio of ur success in court ?? Also bring someone to record ur session or hide a phone already recording when u enter court room. Usually wait until they call the name so you can hit record. No one doesn't seem to do this.m. ugh just stories ...

I dont have audio of my success in court, my freedom is proof of my success, plus you can see my paperwork in the Tender for law. I wasn't dealing with tickets or summons. Criminal charges 2x . The truth is the power that moves me and gives me courage to speak and say what I need to say and nothing more even though I was shaking and facing up to a year in jail or 3 years probation.
