Alan Day all of what you are saying is quite simply that Australia has different Legislation , quote them their Legislation if you like but they can and do choose to ignore their own Legislation when it suits them. So it matters not what does or doesn't exist on their fictitious papers , they no longer follow their own rules.
That is a good point actually. It's not going to matter at all what i quote really. As you said Maximus Legis. Even if there was a body of words to point to they will just ignore it anyway.
If Australia is a signatory to the UN Declaration of Human Rights the surety/security of the person still applies...Australia agreed to acknowledge and uphold these principals when it signed. I recall Signature=Surety... not that they seem to care
