Why is Dean filing MOTIONS? Let's take a minute and play connect-the-dots: "What is MOTION? In practice, an occasional APPLICATION to a court by the parties or their counsel, in order to obtain some rule or order, which becomes necessary either in the progress of a cause, or summarily and wholly unconnected with plenary proceedings. -Law Dictionary: What is MOTION? definition of MOTION (Black's Law Dictionary)" "What is APPLICATION? A putting to, placing before, preferring a request or petition to or before a person. The act of making a request for something. -Law Dictionary: What is APPLICATION? definition of APPLICATION (Black's Law Dictionary)" "What is APPLICANT? This term applies to a PERSON who files a PETITION or makes an application; the petitioner; or the PERSON who is applying for a legal remedy to a problem. -Law Dictionary: What is APPLICANT? definition of APPLICANT (Black's Law Dictionary)" "What is PETITION? A written address, embodying an APPLICATION or prayer from the PERSON or PERSONS preferring it, to the power, body, or person to whom it is presented, for the exercise of his or their authority in the redress of some wrong, or the grant of some favour, privilege, or license. In practice. An application made to a court ex parte, or where there are no parties -Law Dictionary: What is PETITION? definition of PETITION (Black's Law Dictionary)" "What is PERSON? A man considered according to the RANK he holds in SOCIETY, with all the rights to which the place he holds entitles him, and the duties which it imposes. -Law Dictionary: What is PERSON? definition of PERSON (Black's Law Dictionary)" "What is RANK? The order or place in which certain officers are placed in the army and navy, In relation to others. 2. It is a maxim, that officers of, an inferior rank are bound to obey all the lawful commands of their superiors, and are justified for such obedience. -Law Dictionary: What is RANK, n? definition of RANK, n (Black's Law Dictionary)" "What is OFFICER? The INCUMBENT of an office; one who is lawfully invested with an office. One who is charged by a superior power (and particularly by government) with the power and duty of exercising certain functions. -Law Dictionary: What is OFFICER? definition of OFFICER (Black's Law Dictionary)" "What is INCUMBENT? A person who is in present possession of an office; one who is legally authorized to discharge the duties of an office. State v. McCollister, 11 Ohio, 50; Statev. Blakemore, 104 Mo. 340, 15 S. W. 900 -Law Dictionary: What is INCUMBENT? definition of INCUMBENT (Black's Law Dictionary)" "What is SOCIETY? An ASSOCIATION or company of PERSONS (generally not Incorporated) united together for any mutual or common purpose. -Law Dictionary: What is SOCIETY? definition of SOCIETY (Black's Law Dictionary)" "What is ASSOCIATION? The act of a number of PERSONS who unite or join together for some special purpose or business. The union of a COMPANY of persons for the transaction of designated affairs, or the attainment of some common object. An unincorporated society; a body of persons united and acting together without a charter, but upon the methods and forms used by incorporated bodies for the prosecution of some common enterprise -Law Dictionary: What is ASSOCIATION? definition of ASSOCIATION (Black's Law Dictionary)" "What is COMPANY? An organization of INDIVIDUALS conducting a commercial or industrial enterprise. A corporation, partnership, association, or joint stock company. -West's Encyclopedia of American Law, edition 2. Copyright 2008 The Gale Group, Inc. All rights reserved. Company n. any formal business entity for profit which may be a corporation, a partnership, association or individual proprietorship. Often people think the term "company" means the business is incorporated, but that is not true. In fact, a corporation usually must use some term in its name such as "corporation," "incorporated," "corp." or "inc." to show it is a corporation." And INDIVIDUAL, Scott has already covered in recent articles. Reading all of that, MOTIONS sound like a really BAD idea. :p

Ummm: Questions to ask based on the below quote: 'When I got to Brandon the notary asked me to meet at his office to discuss Deans case. He informed me that the Law Society had sent out letters regarding sovereign citizens and how they are a nuisance and taking up unnecessary court time. ' Besides an oxymoron, what is a sovereign citizen? Is that similar to the oxymoron 'courts of justice'? How does one become an oxymoron such as a 'sovereign citizen'? Who deemed/profiled Dean to be this oxymoron? As there are no synonyms and/or homonyms in law, I'm absolutely certain that oxymorons would most definitely be a nuisance that would take up court time unnecessarily :P

Besides the above, isn't the function of the notary to witness a signature regardless of the contents of the document or do they have a duty to make a legal determination based upon the contents of the document?

We have Justices of the peace here, to witness true copies of originals, signatures etc....these are people of standing in the community and they are not allowed to charge for their public service...virtually all notaries here are also lawyers, so I get what you're saying.

More than good enough Capitain Pete. As I recall only two witnesses are needed to accomplish the same thing a notary does.

Every province has its own rules, e.g. http://www.justice.gov.sk.ca/CO-NA. Whether you have 2, 3 or 10 others it won't matter. All they want is 1 under their rules.

It's worse than that: Look up what COMMISSIONER means, legally. Then look up what OFFICER means legally. In some provinces it's "Commissioner of Oaths", and in others it's "Officer of Oaths". ...again, it's just circle-jerking to clubhouse rules for a club that you are not part of.

Wow! There is quite a distinctinction between OFFICER and COMMISIONER. Officer: An individual with the responsibility of performing the duties and functions of an office, that is a duty or charge, a position of trust, or a right to exercise a public or private employment. A public officer is ordinarily defined as an individual who has been elected or appointed to exercise the functions of an office for the benefit of the public. Executive officers, such as the president or state governors, are public officers charged with the duty to ascertain that the law is enforced and obeyed. A legislative officer, such as a member of Congress, has the duty of making the laws. A public officer whose duties include administering justice, adjudicating controversies, and interpreting the laws is called a judicial officer. A de jure officer is one who is legally appointed and qualified to exercise the office. A de facto officer is an individual who appears to be legally qualified and appointed to an office but is not due to some legal technicality, such as failure to file a financial disclosure statement within the time prescribed by statute. A public office must be created either by statute or by constitutional provision. Public officers are distinguishable from employees in that they are required to take an oath of office and are appointed or elected to specified terms of office. The eligibility, duties, and compensation of public officers are defined by statute. Removal from office occurs when an officer is dismissed from his or her position by a superior officer acting according to law. Sufficient cause must exist to justify the removal. When an individual is wrongfully removed from office, he or she may seek reinstatement. A military officer is one who has been commissioned as such in the Armed Services. An officer of a corporation is someone, such as the president, vice-president, treasurer, or secretary, whose main duties are to oversee the efficient operation of the business. http://legal-dictionary.thefreedictionary.com/officer

Commissioner A person charged with the management or direction of a board, a court, or a government agency. A commissioner has the power and responsibility to administer laws or rules that relate to a specific subject matter over which he or she has authority. Generally, he or she is appointed specially, as in the case of a commissioner of court. http://legal-dictionary.thefreedictionary.com/commissioner
