Well your MOTHER was the GRANTOR, and you are a TRUSTEE (Executor). The lawyer's "that's just how it works" is UNACCEPTABLE, and you should tell him to substantiate his position, lest you file a fraud/criminal breach of trust claim against him with the crown. :D
