It matters not where those rights come from, the fact that I exist is what matters, my life is what I value most if I do not have my life I do not exist(Scarcity) If the value associated with the action of helping someone I don't know or bee drowning in a pool is greater than the risk that I assign(Opportunity Cost). I never really thought about breathing as action, but yes I would say it is an action. A perfect example of property is the right to action.
