Will, if they don't reply to an affidavit, send them a notice of default (by now 3/4 months later) with 10-20 days to reply. No reply? Certification of default. Done. It is truth now.

The affidavit was actually sent out Feb 16th Then March 21st they were notified that they had neither replied or opposed the facts stated, and informed that unless they prove any of those wrong within 10 days, those facts would be considered truth and reality. That's where I'm at, and I guess that's indeed more a CERTIFICATE of defaut that they need now... So, same kind of text as posted above, explaining the terms on which they defaulted, notarized ?

I started a thread regarding my arrest 6 months ago, how the Guards (cops) have taken no action within that time (the allotted time to bring a case to a court of summary jurisdiction) and I am now planning on issuing an affidavit plus invoice to the arresting Guard. Unrebutted affidavit, statement, default and a lien... :p

Id like to know what your talking about Adam Thomas. Do you have to send an affidavit first or can ye send the government ( for house tax as example) a Notice, statement and then default them.

I think it takes 28 days for THC to clear your system, especially if you smoke a lot. :D

Back to affidavit... so given 10 days to reply... on that 10th day, you can send a Notice of Fault � Opportunity to Cure (this would be a "good faith" thing but not necessary)... another 5 days... then BAM! �Default

The date, yes the date needs to be in, and the word "AFFIDAVIT", definitly..... :D

Usually affidavit is at the top and on the bottom it would say "Sworn to on this ___ day of ___, 2007. Then witnessed.
