Here's an excerpt from the Waters 'Law of trusts in Canada' text:

" SPECIAL trusts can be further divided into those where the trustee duties are MINISTERIAL or administrative, and those where they are DISCRETIONARY or DISPOSITIVE. Ministerial or ADMINISTRATIVE duties are those involved in the RUNNING OF the trust, for example the keeping of accounts, hiring agents like SOLICITORS and VALUERS. Discretionary duties may be dispositive in the case of the POWER to maintain out of income, or to ENCROACH on capital, for a beneficiary with a FIXED CONTINGENT capital interest, or DISTRIBUTIVE, as with a POWER OF APPOINTMENT. Distributive powers given to trustees require them to ALLOCATE the trust property among class appointees of the power. The power may be a TRUST POWER, or, a MERE power."

When Mayor Ford was a Councillor, he went on the John Oakley Show every Thursday morning and he spilled-his-guts about all the money, and all the various ways, Mayor Miller was PISSING-AWAY money down at City Hall. They've had the knives out for him ever since.

AM640 here in Toronto has a feature every Wednesday called the 'Legal Panel,' where the two lawyers they have come on spoke solely about this situation and about how BADLY these City of Toronto Councillors have fucked-up in acting arbitrarily and tossing-away Mayor Ford's right-to-due process and bringing the administration of justice into disrepute. Kudos Derek Moran; Keep us posted; I'm curious. Scott has mentioned the social programming/experiment/effort more than once as you know. And although I can't prove it, I suspect that Chris's sentiment that you are one of the few left that has the audacity to ask such questions is correct. My hypothesis is that "they" are curious to discover the limits of just how many of our "powers" we are willing to give up without question.

Thanks Robert. Whether its part of the CLUBHOUSE RULES or not, Godbout v. The City of Longeuil was ruled on by the Supreme Court where they said, not once, not twice, but THREE times, that municipalties enact COERCIVE laws upon the people. If more people knew that, the more confident they'd probably feel with overcoming their fear at pushing-back.

Surety resides with the creator, 100%. All the value goes to the surety though the accounting of it. Starting with the implementation of proper notice by invoice.
