My thoughts with a trust is to not include anything that you have outstanding debt on....but they seem to be using this trust to keep the property(s) they owe on still...Scott Scott Duncan this hasn't been challenged in court yet, what are your thoughts on the outcome of a challenge?

They'll lose. Debt is debt. If you don't wan't debt, don't sign for debt.

If many sources are put into the one trust would that not put ALL a risk?

Poorly asked. Say that three people put in properties with debt into the one trust while the rest that are already in have no debt. Would the 3 in debt put the others at risk?
