I think it is very simple. We are (well, I am at least) seeing to much into it. We keep talking / worrying about what to do in court but we really just simple shouldn't be there. So if we have a date to appear we know we should deal with it before that by some means. If we are dragged in then we should be dealing with , They shouldn't be dragging us in to begin with. Forest for the trees so to speak.
