So im out, went along like this...

Got arrested, thrown in paddy wagong, went into the jail house at the cop shop.

Cop "Name"

Me "You telling me you arrested me and dont even know my name?"

Cop "Name and D.O.B"

Me "Not your business for both."

Me "Am i charged personally for anything"

No response.

Was thrown in a jail cell for not even 5 minutes. Was pulled out, Duty Council showed up and i had to go to those special booths. I knew this duty council from past interactions(not bad)

Duty Council "So apparently cops tried to charge you, but the crown couldn't find the LAW you broke."

Me "Allegedly i broke some restraining order?"

Duty Council "No i get that part, the thing is, they cant find a standing restraining order. Is this your little way on dealing with things like you said months back?"

Me "Guess you can say that."

Duty Council "What did you do? You peaked my curiosity"

Me "I just VOIDED everything. I got the certified true copies of all the standing orders or current orders whatever you want to call them and i put it right on top "New Original" and i put a big VOID on where signature would be, or if there was no place holder then i would put it on the last page where it WOULD be"

Duty Council "uh hu....right. Ok well anyways the CROWN is just notifying the Windsor Police Department to release you, they are just completing paperwork."

Me "Ok Thanks"

Duty Council "Oh by the way, i got wind of this because i overheard the CROWN talk about VOID and your NAME, you arent one to be forgotten, you are very unorthidox"

When i was being brought back i didnt go back to the jail cell but where they give your stuff back. I was released not even 10 minutes later. Should have seen the cop whoa arrested me on how flustered he was :)

Good on ya Derek Hill. I have to think back a few years to when you were helping Terry and things did not turn out so well. How we have all changed over the years. Now, with the truth at hand, the fear now dissipating in all of us, we move forward, wielding our new found knowledge with confidence. I sent 2 notices of mistake off in the past 4 days. Canada Post tracking # RW748369655CA and RW785559225CA.The one I had a court date set already for July 16, so I wrote with a thick red sharpie across on the diagonal, CANCELLED, and sent it back. I cannot thank Scott Duncan enough.

Just got a WARRANT TO DISTRAIN FOR TAXES NOTICE from a Bailiff the City of Toronto sent today. . . .im supposing the almighty VOID-stamp would work just as well for a WARRANT also, or is there any material difference between a WARRANT and an ORDER?

This should work for a temporary care and custody order as well. Only question I got is you ask to see original, at the court house if they refuse, you ask for certified copy print new orginal on top and void last page where a signature would go, and then go get my kids out of foster care?

On doing the same thing to the probation order does it have to be the old man named on the order to do this, or can I go in and do this? He is wanted for failure to pay fines right now. So not good idea for him to go in there.

Derek Moran You were give a Warrant? The clerk Gave You a Warrant of Distrain? A Sheriff was NOT acting on this Warrant? If this the case then I see it as they want YOU to Act as an OFFICER to obtain possession of taxes from YOU.

A Warrant would still have come from a claim too. Like "What is the cause (claim) to issue and execute a Warrant." in the first place. (I know they operate on presumption. This is why we shouldn't be in their administrative hearings anyway.)

I have imaginary balls, and I am going in deep. Tomorrow morning I have visitation at my friendly, backstabbing, lying and outrageous Department of Community Services to spend my allotted 1 hr twice a week with my girls. And after I will go down to the court house to either "see" the original or a certified copy of that Temporary Care and Custody Order. And when I leave there I will be returning back to the friendly DCS office and hand them a letter that the order has been voided and I demand the return of my offspring. And like Derek Hill I shall keep you posted. LOL I can hardly wait. This is going to be so much fun.

Yes, they have concerns for the kids and access workers' safety because we refuse to do counseling any more or do a Psych/Parental Capacity Assessment. Although I informed them that their access worker was falling asleep at the visits, was over 60 and had no cell phone. That didn't seem to bother them then. Since Oct. 30 of last year, when I told them that we weren't participating any more, we have been reduced to in office access, 1 hr twice a week and if for any reason they got cancelled on their part, Too bad. They don't make them up. The crazy part is DCS told me that at the time the access worker wasn't required to carry a cell phone, wasn't part of their contract.

Pete Daoust if I had the capabilities, equipment and technical ability, I would post a video. However, the only thing that I can do is give you a play by play when it is all over and done with. It won't be till mid afternoon cause visitation is from 9 - 10 in the morning. And I'm not expecting the court house to cooperate with me. Cause I have started some other shit there that I am on a first name basis with them. They groan when I come in there. I already have a second notice of a criminal complaint that has come due with the prothonotary and the Justice of the Supreme Court of NS for fraud and conspiracy. Like I said this should be fun tomorrow.

Chad Brodgesell- yes, yesterday afternoon i picked-up my red-ink VOID-stamp from Staples for $11.94 (an extra $15 if you order it online for delivery), and when i got home a private-Bailiff acting as agent for the City of Toronto had dropped-off an envelope to the house.

a WARRANT TO DISTRAIN FOR TAXES, that had my dads name last name first, then his first and middle name in Upper/Lower-case. The letter/Notice started off though with- "You are herewith...blahblahblah"

Inside the envelope was a NOTICE OF INSUANCE TO BAILIFF from the City of Toronto, my dads name in same formation but in ALL-CAPS, with the letter starting-off- "Dear Taxpayer"...i asked my dad, is YOUR name TAXPAYER?

What is defined as sole administration? Sole Administration = Sole Custody? No its not, someone can have sole physical custody but have no legal custody. So it cant be that.

Well people, this morning went for my visit, and after I tried desperately to get one of those self-inking VOID stamps but none to be had in this small town. Got a red marker instead. Went down to the court house and asked to see the original court order. Family court clerk came out with an armful of files and papers and dug though the paper work and showed me the original order. But then she said that the original order had no force and effect that the last order was the one that had the force and effect. So my mind raced to make a decision with a 50/50 percent chance of being right. While the clerk was busy digging through the paper work, I brought out my red tip marker and set it where she couldn�t see it. But it rolled ahead any ways but she didn�t have a clue as to what I was going to do next. So I made the big instant decision that I would go with the order that had force and effect and looked for the last page. Took my red maker and wrote void on the last page with the signature on it. She watched me do this and I couldn�t see her expression at the time but I noticed that after I did this she became a little upset. She said, � I can�t believe you just did that. You know, that writing void on there doesn�t do anything, it is still a judges order.� I didn�t say anything, I just stood there waiting for her to call the sheriffs over or someone else. She didn�t she just started to put all of her paper work back in the folder and I just turned and walked out. I had parked my car elsewhere in case of anything and walked over to it and got in and drove away. I stopped off at my friendly neighborhood DCS office and dropped off this letter to them.

I am a human being with inherent unalienable rights attached, I am not the legal person. I have pointed out to you and your agency that I don�t consent or contract with you. On numerous occasions I have declined and not consented to the Temporary Care and Custody Order. You have kidnapped my offspring and held them in detention without proof of claim. I have asked for such evidence and you have failed to produce it. I have asked for you to produce evidence that I am contracting with you or consenting and you have failed to produce it. You have failed to produce evidence that I have harmed or injured my offspring. The worst part is that when you took them into your �care�, did you do due diligence in establishing that my offspring where harmed in any way? No, and you have produced no such evidence. As a matter of FACT you chose to take 42 days to take them for a medical, although you claim that you took them in 30 business days. You at the onset of the Protection Application, had an opportunity to court order an assessment and chose not to. Where is your evidence that my offspring were emotionally harmed? You have none. All of your actions are unlawful. I now advise you that this morning I have voided the Temporary Care and Custody Order. I DEMAND that you return my offspring immediately to their mother and father before you cause any more damage or injury. YOU HAVE NO LEGAL OR LAWFUL RIGHT TO KEEP MY OFFSPRING.

My only question now is, did I pick the right order to void?

got a notice of motion, babys mama is asking for costs (through her lawyer ofcourse) and to be payable immediately.

She stated that in her affidavit that she is enduring financial hardship and threatens her employment.

She is also asking for reinstatement of a restraining order to preserve her ability to care for the child.

Question Scott, if you wanted to VOID a marriage contract, could you implement it this way as well? I understand it is not a CLAIM directed toward your PERSON... and just a registered SECURITY. Then would it be that both PARTIES should get their hands on the original contract and VOID it? Or can just one of the PARTIES can do this?

I'm not sure but the Government seems to be a party in this marriage deal, this Marriage CERTIFICATE seems to be kept IN-TRUST with them, so if I want to void this, I need other parties's agreement as well ?

I went today and tried to retrieve my two kids. I went down to get a notice of demand notarized. The lawyer refused to do it because he said that, even the prime minister couldn't void a court order. I told him that all he was doing was witnessing my signature. He stated that he knew the order couldn't be voided and that was untrue and there for he couldn't do his notarizing. But as I was leaving he did tell me that I could let him know how things turned out. Any ways as it turned out the foster parent had left and I scooted over to pick up the middle one, but to get the youngest one, was tougher and didn't happen. So she is still there in detention, poor baby. But we will try again. They did get wise to us trying to get Carole so we just let it go for today. As I was busy getting the kids the rcmp showed up at the house trying to serve the old man with failure to pay court fines. Any how it should be an interesting weekend. Very happy to have one home and looking forward to getting the other one.

Was quick only 3 hearings scheduled, mine was first 10am sharp.

went something along like this.

Lawyer "This motion is brought against the applicant on grounds that even though that all major issues has been settled, we are left with an enormous bill. This financial hardship is impacting my clients ability to travel to work and also a bill unpaid to my place of business in order to continue with my work. A BILL that was CREATED BY THE APPLICANT is unreasonable.

JUSTICE "What bill is this? I see nothing attached to the affidavit."

Me "Ok thats nice. This isnt my problem, i am only here to see to it. It is important to keep in mind that i VOIDed the orders, i didnt create the bill the bill was there already. Just to clarify, is the RESPONDENT's LAWYER NOT SURETY for this matter?"

JUSTICE "If it isnt you then who else would it be?"

Lawyer "YOUR HONOUR, This is unreasonable. This "nonsense" precedure that the applicant has done to think that he can simply VOID orders that simply does not benefit him!"

Me "I must require the lawyer for this matter to simply admit that an ORDER is NOT A CONTRACT made by the SUPERIOR COURT OF JUSTICE?"

JUSTICE "You want to get that question MISS LAWYER?"

Lawyer is completely silent.

Me "Do i hear any objections or any evidence to the contrary?"

Me "Let the record reflect that no objections were made"

JUSTICE "Mr.Hill"

Me "Objection, Mister is a subject, Call me Derek"

JUSTICE "Ok Derek, what is your defence for this motion?"

Me "Well i really dont care if this order is going to be made. The record already reflects that ORDERS are contracts, so i can simply just VOID this one too, i have a sneaking suspicion that the SURETY for this matter is going to be hit with another bill. I do not WISH for that."

JUSTICE is staring intently into the case file contemplating what to do. About 60 seconds go by.

JUSTICE "I do not believe that this order is appropriate. Therefor i am not issuing an order."

Lawyer "Thank you your honour."

JUSTICE "Let me say a word, MISS LAWYER. It would be very unwise to ask for any other ORDER that would put the applicant as a party to it. HE has done nothing wrong, and it would be wise for you to dust off some books as you appear to forgotten how we do things here."

JUSTICE "I trust that this is to your satisfaction Derek?"

Me "Sure? I dont really care."

So today just reaffirms the VOID method.

My memory is a bit hazy because i am just so tired and exhausted.

Derek Hill, I know that this works. DCS has not even bothered to phone me or send someone to get the kid at our home. however they have sent the kid a text telling her that they are all so worried and concerned for her safety, but they waited till 11 am the next morning to text her. I know that this works, It is just a matter of being able to get the youngest. I have my one hour visitation on Monday again. I know afterwards I will be going to the courthouse, lol, and asking for certified copies of the fine order and probation order. I'm sure they wont let me near the originals any more. Lol This is so much fun. It is wonderful to be able to get ahead of them for a change.

I have accused 5 rcmp officers in our town of lying and I don't think that they will back me up. What Im thinking of doing is getting the kid on Monday maybe even before the visit. hopefully I can park close to where the worker is going to park and just scoot her into the car and go. mission accomplished.

I already went this morning to her camp and they sent three workers out, telling me that Im not allowed there. I was parked on the street. I told them this is public property and by what authority can they tell me that I can't be there? Well you know that you are not allowed around your daughter. So I don't want to create a scene, especially with all the other disabled children there. So I just thought that I would let it go till Monday, when I would be in a better position to deal with it.

Brenda- its important to note, that lady was right when she said: "...not even the prime minister could void the order!" However, its also important to note that government-workers speak in HALF-TRUTHS. The PM couldnt void YOUR order, the same as, YOU couldnt void HIS order ;)

Somebody further back was asking about this - VOID MARRIAGE. One not good for any legal purpose, the invalidity of which may be maintained in any proceeding between any parties, while a "voidable marriage" is one where there is an imperfection which can be inquired into only during the lives of both of the parties in a proceeding to obtain a sentence declaring it void. State v. Smith, 101. S.C. 293, 85 S.E. 958, 959, Ann. Cas.1917C, 149. "Voidable marriage" is valid for all civil puposes until annulled in direct proceedings, but "void marriage" is nullity and may be impeached at any time. Pridgen v. Pridgen, 203 N.C. 533, 166 S.E. 591, 593.

Now that i am back home....

Scott Duncan, how do you deal with police arrests for VOID orders.

I just confirmed that the restraining orders are STILL in the police system(because i got arrested briefly). How can you effectively deal with it so its completely removed.

Because now that police knows my face now, what would you say when police is trying to arrest you or look for anything to arrest you?

I was able to get out one kid from CPS's tangled web but now they have gone and hid the other one. I went just now to get a certified true copy of my family court order, and was denied because I have put marks on it and it is in the judges hands now as to what to do with it. Luckily tomorrow is family court day, so I should know what is to become of my situation. They have texted and called my phone and the kids phone, and we never called or texted back. Today was the kid's last chance to call the cps office. Oooooooooh, we are scared. I was supposed to have a visit with the younger one, but surprise they never advised me that it was a no go. As a matter of fact I showed up at the office and the receptionist told the supervisor that I was there. I waited around for 15 minutes and she never came out so, I said fuck that and left. I have an idea where she may be at in another town. I'm waiting to see what will happen tomorrow, and then maybe go on the hunt. The one funny thing that was taking place at the court house today was that no one would dare put any paperwork down in front of me. They did try giving me copies of the family court order that I had returned to them. They tried really hard. But I told them No, I want a certified true original. The court clerk tried to pass it on to me and when that didn't work, the court administrator tried really hard as well. Too funny.

nevertheless its filed in the court file that i served the voided orders to the windsor police department.

yes but isn't VOIDing court orders and notice of mistake is running in opposite sides.

VOIDing is because you "are DEREK HILL" because you have the right to not contract, while notice of mistake you are removing your self completely from everything.

But see then you are feeding into their crap cause then they can say see we told you there were problems, we knew we were right to have concerns, this is why we did this. I probably will flip eventually. When I was in court and did the point of order thing in April, they already used the way I presented myself in court that day against me saying that is why they have not agreed to let me have more visitation.

Oh how desperate these people have become. They are trying to move the contract by ignoring the notice of mistake. I think that this is how I would respond if not just to imagine the look on the face of the recipient. What they sent: NOTICE OF TRIAL Re: Blah��������.. This is to advise that the not guilty plea submitted has been received within the time provided. A trial respecting the above has been set as follows: All the address stuff. If you cannot proceed to trial on the above scheduled date, you must attend in person at the Justice of the Peace counter no later than 7 business days prior to the trial date, to request an adjournment. Should you fail to appear on the above day, you may be convicted in absence and liable for any fine that the court orders and Late Payment Penalty charges may apply. Clerk of the Court Although I know that the correct response is the Notice of Mistake again, my lampoon take on the reply. Dear Clerk of the Court Thank you for such an expedient arrest of the Surety known as �you�. This most certainly is a Breach of Trust, amongst many other Criminal Code of CANADA offences�. And they pleaded not guilty? What arrogance! As Beneficiary of the Trust in matter, I appreciate your notification of this arrest and am quite satisfied that you will continue the good work and prosecute this, �You�, person to the full extent your Statute Laws. I hope that you will keep updating me on this matter and provide me the name of this Trustee/Public Servant so as to take Civil Actions from my end as well. The Beneficiary looks forward to receiving a certified cheque through the REGISTERED POST for the amount paid in fines within 7 business days after the court date of November 23, 2013. GOD BLESS YOU <----(Please don�t ban me for this)

Brenda Larson, I think what you are doing for your children is heroic and ANY suffering your children are experiencing is on CPS hands. The most a child can hope for is parents who fight for their rights and never give up until the child chooses to fight on their own (and asks the parent to just be there). So few even stand for themselves.
