So im out, went along like this... Got arrested, thrown in paddy wagong, went into the jail house at the cop shop. Cop "Name" Me "You telling me you arrested me and dont even know my name?" Cop "Name and D.O.B" Me "Not your business for both." Cop "Throw him in a jail cell" Me "Am i charged personally for anything" No response. Was thrown in a jail cell for not even 5 minutes. Was pulled out, Duty Council showed up and i had to go to those special booths. I knew this duty council from past interactions(not bad) Duty Council "So apparently cops tried to charge you, but the crown couldn't find the LAW you broke." Me "Allegedly i broke some restraining order?" Duty Council "No i get that part, the thing is, they cant find a standing restraining order. Is this your little way on dealing with things like you said months back?" Me "Guess you can say that." Duty Council "What did you do? You peaked my curiosity" Me "I just VOIDED everything. I got the certified true copies of all the standing orders or current orders whatever you want to call them and i put it right on top "New Original" and i put a big VOID on where signature would be, or if there was no place holder then i would put it on the last page where it WOULD be" Duty Council "uh hu....right. Ok well anyways the CROWN is just notifying the Windsor Police Department to release you, they are just completing paperwork." Me "Ok Thanks" Duty Council "Oh by the way, i got wind of this because i overheard the CROWN talk about VOID and your NAME, you arent one to be forgotten, you are very unorthidox" Me "Uh..thanks?" When i was being brought back i didnt go back to the jail cell but where they give your stuff back. I was released not even 10 minutes later. Should have seen the cop whoa arrested me on how flustered he was :)

So i think i made my point clear. Now to take my next plan of action fufufufufufu

Yes, they have concerns for the kids and access workers' safety because we refuse to do counseling any more or do a Psych/Parental Capacity Assessment. Although I informed them that their access worker was falling asleep at the visits, was over 60 and had no cell phone. That didn't seem to bother them then. Since Oct. 30 of last year, when I told them that we weren't participating any more, we have been reduced to in office access, 1 hr twice a week and if for any reason they got cancelled on their part, Too bad. They don't make them up. The crazy part is DCS told me that at the time the access worker wasn't required to carry a cell phone, wasn't part of their contract.

Well people, this morning went for my visit, and after I tried desperately to get one of those self-inking VOID stamps but none to be had in this small town. Got a red marker instead. Went down to the court house and asked to see the original court order. Family court clerk came out with an armful of files and papers and dug though the paper work and showed me the original order. But then she said that the original order had no force and effect that the last order was the one that had the force and effect. So my mind raced to make a decision with a 50/50 percent chance of being right. While the clerk was busy digging through the paper work, I brought out my red tip marker and set it where she couldn�t see it. But it rolled ahead any ways but she didn�t have a clue as to what I was going to do next. So I made the big instant decision that I would go with the order that had force and effect and looked for the last page. Took my red maker and wrote void on the last page with the signature on it. She watched me do this and I couldn�t see her expression at the time but I noticed that after I did this she became a little upset. She said, � I can�t believe you just did that. You know, that writing void on there doesn�t do anything, it is still a judges order.� I didn�t say anything, I just stood there waiting for her to call the sheriffs over or someone else. She didn�t she just started to put all of her paper work back in the folder and I just turned and walked out. I had parked my car elsewhere in case of anything and walked over to it and got in and drove away. I stopped off at my friendly neighborhood DCS office and dropped off this letter to them. I am a human being with inherent unalienable rights attached, I am not the legal person. I have pointed out to you and your agency that I don�t consent or contract with you. On numerous occasions I have declined and not consented to the Temporary Care and Custody Order. You have kidnapped my offspring and held them in detention without proof of claim. I have asked for such evidence and you have failed to produce it. I have asked for you to produce evidence that I am contracting with you or consenting and you have failed to produce it. You have failed to produce evidence that I have harmed or injured my offspring. The worst part is that when you took them into your �care�, did you do due diligence in establishing that my offspring where harmed in any way? No, and you have produced no such evidence. As a matter of FACT you chose to take 42 days to take them for a medical, although you claim that you took them in 30 business days. You at the onset of the Protection Application, had an opportunity to court order an assessment and chose not to. Where is your evidence that my offspring were emotionally harmed? You have none. All of your actions are unlawful. I now advise you that this morning I have voided the Temporary Care and Custody Order. I DEMAND that you return my offspring immediately to their mother and father before you cause any more damage or injury. YOU HAVE NO LEGAL OR LAWFUL RIGHT TO KEEP MY OFFSPRING. My only question now is, did I pick the right order to void?

I went today and tried to retrieve my two kids. I went down to get a notice of demand notarized. The lawyer refused to do it because he said that, even the prime minister couldn't void a court order. I told him that all he was doing was witnessing my signature. He stated that he knew the order couldn't be voided and that was untrue and there for he couldn't do his notarizing. But as I was leaving he did tell me that I could let him know how things turned out. Any ways as it turned out the foster parent had left and I scooted over to pick up the middle one, but to get the youngest one, was tougher and didn't happen. So she is still there in detention, poor baby. But we will try again. They did get wise to us trying to get Carole so we just let it go for today. As I was busy getting the kids the rcmp showed up at the house trying to serve the old man with failure to pay court fines. Any how it should be an interesting weekend. Very happy to have one home and looking forward to getting the other one.

Lawyer "This motion is brought against the applicant on grounds that even though that all major issues has been settled, we are left with an enormous bill. This financial hardship is impacting my clients ability to travel to work and also a bill unpaid to my place of business in order to continue with my work. DCS has not even bothered to phone me or send someone to get the kid at our home. however they have sent the kid a text telling her that they are all so worried and concerned for her safety, but they waited till 11 am the next morning to text her. I know that this works, It is just a matter of being able to get the youngest. I have my one hour visitation on Monday again. I know afterwards I will be going to the courthouse, lol, and asking for certified copies of the fine order and probation order. I'm sure they wont let me near the originals any more. Lol This is so much fun. It is wonderful to be able to get ahead of them for a change.

Now that i am back home.... Scott Duncan, how do you deal with police arrests for VOID orders. I just confirmed that the restraining orders are STILL in the police system(because i got arrested briefly). How can you effectively deal with it so its completely removed. Because now that police knows my face now, what would you say when police is trying to arrest you or look for anything to arrest you?

I was able to get out one kid from CPS's tangled web but now they have gone and hid the other one. I went just now to get a certified true copy of my family court order, and was denied because I have put marks on it and it is in the judges hands now as to what to do with it. Luckily tomorrow is family court day, so I should know what is to become of my situation. They have texted and called my phone and the kids phone, and we never called or texted back. Today was the kid's last chance to call the cps office. Oooooooooh, we are scared. I was supposed to have a visit with the younger one, but surprise they never advised me that it was a no go. As a matter of fact I showed up at the office and the receptionist told the supervisor that I was there. I waited around for 15 minutes and she never came out so, I said fuck that and left. I have an idea where she may be at in another town. I'm waiting to see what will happen tomorrow, and then maybe go on the hunt. The one funny thing that was taking place at the court house today was that no one would dare put any paperwork down in front of me. They did try giving me copies of the family court order that I had returned to them. They tried really hard. But I told them No, I want a certified true original. The court clerk tried to pass it on to me and when that didn't work, the court administrator tried really hard as well. Too funny.

Brenda Larson, I think what you are doing for your children is heroic and ANY suffering your children are experiencing is on CPS hands. The most a child can hope for is parents who fight for their rights and never give up until the child chooses to fight on their own (and asks the parent to just be there).
