From my understanding, WE all may be better served if we provide a Notice for DISCHARGE as opposed to setoff. I recall Winston Shrout stating he thought DISCHARGE is preferable because the debt is "written off", as opposed to being settled some time in the future. SETOFF retains the debt on the books, indicating it will be dealt with in the FUTURE, while DISCHARGE gets the debt off the books, which serves us all. <-- I hope this isn't a shit stain! :)

Cara, this is with a second document, after the first being a tender for setoff. With NO response after that, send a NOTICE OF DEFAULT, OPPORTUNITY TO CURE with an affidavit as such for the purposes of enforcement of the instrument previously accepted and apparently ignored. If they do not rebut the affidavit and again ignore it, you have a default.

I found a US version of this with some stuff I was researching and just wrote my own. I don't know what it is SUPPOSED to look like or SUPPOSED to be titled... I don't care. Its the point. Basically going through everything you now understand about remittances, negotiable instruments and the fact that the bank is operating in bankruptcy and provides only the service of EXCHANGE... Where is their claim coming from? They are PULLING IT OUT OF THEIR ASS... prove your claim I owe you ANYTHING but a swift kick...

To identify a document as a affidavit and include the info on is just something I did before I landed here, so it is clicking.. is all. Different methodology with some cool results. There is no one to rebut so why not?

The way I understand it, if you are going to challenge a claim... then to keep it out of a court situation (where you don't belong), it needs to be fully administrated to a default. If an affidavit is truth until rebutted, then is not rebutted... it is done.
