My understanding thus far:
The NOTICE OF MISTAKE clears up a mistaken presumption(s) by the court & disassociates the word 'YOU' & the name in question from the MAN in front of them, thereby deflecting surety & making it very clear that you cannot be acting as trustee for that name/account/charge/instrument.
It keeps you in honour and removes any presumptions that the court may have about who 'YOU' are (or in this case are not).
It allows the court to get on with its own business of administering an account that they created and mistakenly presumed you to be acting as trustee/surety for.
'Members of the Private Bar Guild presume you.......' etc etc...Members of a private group wish to involve me in their private business...says it all really...they even gave me the paperwork...If they are able to presume this, then they must be able to 'presume' a valid employment contract, timesheets, payslips, holiday pay, long service leave etc...
The NOTICE OF MISTAKE clarifies this error in presumption because I can't resign if I'm not formally 'employed' in the first place, regardless of their private presumptions and private clubhouse rules.
I was given the paperwork to become an employee & they never hired me & I never started work...I'm just making sure that mistake is made clear whenever I deal with them...nothing more, nothing less.
There's probably several ways to skin a cat...but why?
Court & dealing with these people can be highly stressful...why make life more stressful & difficult for yourself?
Use the notice, stick to your guns by responding: Objection, until I have the questions in the notice answered, I am unable to understand the nature and cause of these proceedings...
