"If this open �stay� does not cause him any harm (and it shouldn�t) he can choose to do nothing or he can file a two page �Motion to Dismiss� ..." If a stay is in place then there are probably no actual grounds for a prosecution's action to proceed so MOTIONING the court would be a bad idea at that point I would have thought?
