You miss the point. The court admittet that THEY THEMSELVES have no jurisdiction. They accepted that he had the right to demand it, but if it's his position that they have no jurisdiction, neither do their superiors, so why send the case there?

The court does not DENY and actually ACCEPTS that they have no jurisdiction. That is the basis for denying an appeal!
If you go to the dentist and say "Gimme a new fuel injector for my car", he's going to say no, and bill you for the time you wasted.
